Sponsor: The NOW Foods "Mental Wellness" Sweepstakes (the "Sweepstakes") is sponsored by NOW Health Group, Inc. dba “NOW Foods,” 244 Knollwood, Bloomingdale, IL 60108 (referred to as "Sponsor").

Eligibility: The Sweepstakes is only open to legal residents residing in the fifty United States and the District of Columbia, who are 18 years of age or older. ONLY ONE ENTRY PER PERSON IS PERMITTED DURING THE SWEEPSTAKES ENTRY PERIOD. The following persons are not eligible to participate: employees, affiliates, subsidiaries, contractors, advisors, representatives, and individuals otherwise directly affiliated with Sponsor or this Sweepstakes as well as the immediate family (spouse, mother, father, sister, brother, daughter, or son, and/or “step” regardless of where they live) or such persons or members of their households (whether related or not). The Sweepstakes is subject to all federal, state, and local laws and regulations and IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW. Entrants are responsible for understanding and adhering to these Official Rules.  Sponsor will not award a prize to anyone not meeting the eligibility requirements at the time of entry.

Application of Official Rules: By entering this Sweepstakes, entrant acknowledges that he or she has read, understands and agrees to abide by these Official Rules.  Sponsor reserves the right to disqualify any entrant if these Official Rules are not followed.  Sponsor retains the sole right to administer these rules and Sponsor’s decision is final and binding.  All Sweepstakes entries not in compliance with these Official Rules will be subject to disqualification as determined exclusively by Sponsor, without notice to entrant.  In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotional material and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control.

Sweepstakes Entry Period: The Sweepstakes begins at 9:00 a.m. Central Standard Time (CST) on October 9, 2024, and ends at 11:59 p.m. CST on October 28, 2024 (“Sweepstakes Entry Period”).

Where to Enter: NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. To enter the Sweepstakes, you must during the Sweepstakes Entry Period (1) visit https://www.nowfoods.com/wellnesssweeps; (2) enter the correct information on the entry submission form (first name, last name, and e-mail address); and (3) read the Official Rules and click your acceptance of these Official Rules in the appropriate pop-up box. Entering your name and e-mail address indicates entrant’s willingness to receive from Sponsor an e-mail reply notifying entrant if he or she is a potential winner.  If an entrant enters the Sweepstakes more than once through the website, the entrant’s first submission will be the only valid entry for the Sweepstakes.

Representations and Warranties: By entering this Sweepstakes, entrant represents and warrants that: (1) any and all information submitted is true and accurate in all respects and Sponsor may rely on such information in its efforts to comply with applicable laws; (2) any and all information submitted does not contain falsehoods or misrepresentations; and (3) entrant is not impersonating another person.

Winner Selection: At the end of the Sweepstakes Entry Period, one (1) prize winner will be selected in a random drawing on or before November 4 , 2024.  Sponsor reserves the right to disqualify any entry that, in Sponsor’s sole discretion, violates these Official Rules.

Prize and Odds of Winning: There will be one (1) prize awarded during the full contest period.  The prize will consist of a promo code worth two hundred fifty dollars and zero cents ($250.00). Any associated taxes will be the sole responsibility of the prize winner.  The actual retail value of the prize is $250.00.  The odds of winning will depend on the number of eligible entries received.  Any, and all prizes will be delivered only to an address located in the United States of America.

The prize is non-transferrable and no substitution is allowed, except by Sponsor in its sole discretion.  In the event a prize or a component of the prize package is not available, Sponsor may substitute a prize or component thereof of equal or greater value.  The prize may not be redeemed for cash or returned.

Promo Code Terms and Conditions: Use of the promo code is subject to NOW’s Promotional Code Program Terms & Conditions located at https://www.nowfoods.com/terms-and-conditions-now-promotional-code-prog….  The promo code may only be redeemed on nowfoods.com and is valid for a limited time. The promo code will expire one (1) year from the date of issuance as noted in the email accompanying the promo code. You may apply the promo code to any shipping and handling costs associated with your order. You may not return any merchandise purchase with a promo code for a refund of any kind. The promo code is not a gift card or credit card and cannot be used as one. Promo codes are limited to the funds associated with that promo code and you cannot increase the funds associated with the promo code. Please keep the promo code in a safe and secure location because the promo code cannot be replaced if it is lost, stolen or used without your permission. The promo code is void where prohibited by law.

Taxes: All federal, state and local taxes associated with the prize, including income taxes, are the sole responsibility of the applicable winner.

Use of Entrant Information/Privacy Policy: Entrant information will be used by Sponsor in accordance with its privacy policy.  For information on how to opt out of receiving any such promotional or marketing information from Sponsor, please visit Sponsor’s privacy policy at: https://www.nowfoods.com/privacy-policy. Sponsor may also use entrant’s personal information to verify entrant’s eligibility to participate in the Sweepstakes and/or otherwise verify the eligibility of entrant.

Notice/Verification of Potential Winner and Delivery of Prize: Sponsor will attempt to contact the potential winner via the e-mail address listed in the entry submission form provided by entrant within five (5) business days of selection.  It is entrant’s responsibility to ensure his or her contact information is current.  The potential winner must confirm receipt of notification within ten (10) days of receipt to claim his or her prize; otherwise, he or she may forfeit his or her prize, and an alternate winner may be chosen among remaining eligible entries. Sponsor is not responsible for the inability to contact a potential winner by his or her contact information or the potential winner's failure to receive notification of winning entry or late receipt of notification by the potential winner. Sponsor will award prize only upon winner confirmation and verification.

Terms and Conditions/Limitations of Liability: WINNER AND ENTRANTS AGREE, EXCEPT WHERE PROHIBITED BY LAW, TO RELEASE AND DISCHARGE, HOLD HARMLESS AND INDEMNIFY SPONSOR, ITS AFFILIATES, SUBSIDIARIES AND ALL OF THEIR RESPECTIVE, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM: (1) ANY AND ALL  LIABILITY THAT MAY BE IMPOSED  OR ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE; (2) ANY AND ALL CLAIMS, ACTIONS, PROCEEDINGS AND LIABILITY FOR ANY DAMAGES, EXPENSES, FEES, INJURY OR LOSSES SUSTAINED IN CONNECTION WITH THIS SWEEPSTAKES; AND (3) ANY BREACH OF WARRANTY OR REPRSENTATION BY ENTRANT.  WITHOUT LIMITING THE FOREGOING, THIS DISCLAIMER DOES NOT APPLY TO ANY PRODUCT WARRANTY OFFERED BY THE MANUFACTURER OF THE PRIZE.  Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes; to be acting in violation of these Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. 
ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DAMAGE DELIBERATELY ANY WEBSITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

IN NO EVENT WILL SPONSOR, ITS AFFILIATES, SUBSIDIARIES OR THEIR RESPECTIVE  OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR DAMAGES FOR LOST PROFITS, REVENUE, OR OPPORTUNITY, OR FOR BUSINESS INTERRUPTION, ARISING OUT OF ENTRANT’S ACCESS TO AND USE OF SPONSOR’S WEBSITE.  EVERYTHING ON SUCH SITES OR ANY PRIZE WON IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS, IMPLIED, OR COLLATERAL, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. General Conditions: If any one or more provisions of these Official Rules are held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the validity, effect, or enforcement of any other provision or provisions of these Official Rules.  Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Force Majeure: The failure of Sponsor to comply with any provision of these Official Rules due to an act beyond Sponsor’s control, including without limitation infection by computer virus, worms, bugs, tampering and unauthorized intervention, fraud, technical failures, acts of God, hurricane, war, terrorism, fire, riot, earthquake, actions of governmental authorities outside the control of Sponsor, or other acts beyond the control of Sponsor, shall not be considered a breach of these Official Rules. If, for any reason, the Sweepstakes is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that, in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right, in its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes and select the winner from entries received prior to the action taken.

Governing Law; Jurisdiction; Venue: These Official Rules shall be interpreted in accordance with Illinois law without regard to its conflicts of law provisions. Entrants agree that the state and federal courts located in Illinois shall have exclusive jurisdiction over any dispute arising from or relating to these Official Rules, this Sweepstakes or entrants' participation in this Sweepstakes, and entrants' consent to the personal jurisdiction and venue thereof.
