TERMS AND CONDITIONS FOR THE NOW® PROMOTIONAL CODE PROGRAM

Welcome to NOW Health Group, Inc. dba NOW Foods’ (“NOW”) Promotional Code Program (“Program”). The following terms and conditions (the “Agreement”) apply to any NOW® physical and/or electronic promotional card and/or code labeled as such (hereinafter referred to as “NOW® Promotional Code(s)”).  By using or redeeming NOW® Promotional Codes, you agree to be bound by the terms and conditions contained in this Agreement, as well as any future terms and conditions.  We reserve the right to modify any of the terms and conditions in this Agreement, in whole or in part, at any time without notice, even though this may affect your redemption of the NOW® Promotional Codes.  Your continued participation in the Program or future use of the NOW® Promotional Codes constitutes your acceptance of this Agreement.

  1. Expiration.  All NOW® Promotional Codes will expire one year from the date of issuance, which date is noted in the email accompanying the promotional code.
  2. Eligibility. You must be 18 years or older to participate in the Program or to use or redeem a NOW® Promotional Code.
  3. How to Redeem.  To redeem your NOW® Promotional Code, you must obtain access to the Internet and visit our on-line store at nowfoods.com.  To redeem your NOW® Promotional Code, place all the products you would like to purchase in your shopping cart. Redeem your NOW® Promotional Code by entering the NOW® Promotional Code in the space provided on the Checkout page and your Promotional Code will be applied to your purchase.
  4. Restrictions of Use.  
  • The NOW® Promotional Code is valid for a limited time.  All NOW® Promotional Codes will expire one year from the date of issuance as noted in the email accompanying the promotional code. 
  • The NOW® Promotional Codes may be used more than once.  The NOW® Promotional Code may be used until the balance associated with the Code is depleted subject to the expiration date noted above.  
  • NOW® Promotional Codes may only be redeemed at NOW’s on-line store at nowfoods.com, and may not be used for in-store purchases or on any third-party website, regardless of whether such retail store or third-party website offers or sells NOW® products.  If you attempt to use the NOW® Promotional Code at any third party website other than nowfoods.com or any retail store, your purchase will be declined.
  • You may apply the NOW® Promotional Code to any shipping and handling costs associated with your purchase order.  Please note that nowfoods.com does charge shipping and handling costs for any product ordered from its website.
  • Please note that nowfoods.com does not ship any merchandise to addresses located outside the United States of America.
  •  If the NOW® Promotional Code is less than the total purchase price of your purchase order from nowfoods.com, you will be asked to pay the balance displayed on the order summary with a credit card (American Express, Discover, MasterCard and Visa) or PayPal. 
  • You may not return merchandise purchased with the NOW® Promotional Code for a refund of any kind.  In the event your purchase was paid for using a NOW® Promotional Code and your credit card, you will only receive a refund for the amount purchased on your credit card in accordance with the nowfoods.com refund policy.    
  • NOW® Promotional Codes are not valid on prior purchases.
  • NOW® Promotional Codes have no cash value and may not be redeemed for cash or a gift card.
  • NOW® Promotional Codes can be combined with any other offer or discount provided by nowfoods.com.
  • NOW® Promotional Codes are not a gift card or a credit card and cannot be used as one.  NOW® Promotional Codes are limited to the funds associated with that NOW® Promotional Code and you cannot increase these funds associated with the NOW® Promotional Code.
  • NOW® Promotional Codes are void where prohibited by law.
  1. No Replacement.  Please keep the NOW® Promotional Code in a safe and secure location because the NOW® Promotional Code cannot be replaced if it is lost, stolen or used without your permission. 
  2. Modification and Termination of Promotional Code Program.  NOW reserves the right to modify any of the terms and conditions of this Agreement, in whole or in part, at any time without notice even though this may affect your right to use your Promotional Codes.  Your continued use and redemption of the NOW® Promotional Code constitutes your acceptance of any changes to this Agreement and you are responsible for remaining knowledgeable of any changes that we make to this Agreement.  At the bottom of the Agreement, we will indicate the date it was last updated.  
  3. Limitation of Liability. NOW HEALTH GROUP, INC. IS NOT RESPONSIBLE OR LIABLE FOR INCORRECT OR INACCURATE TRANSCRIPTION OF INFORMATION, FOR PROBLEMS RELATED TO THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH THE NOW® PROMOTIONAL CODE PROGRAM, FOR ANY HUMAN ERROR, FOR ANY INTERRUPTION, DELETION, OMISSION, DEFECT OR LINE FAILURE, FOR ANY TELEPHONE, CELLULAR NETWORK OR ELECTRONIC TRANSMISSION, FOR ANY OTHER TECHNICAL OR NON-TECHNICAL ERROR OR MALFUNCTION, FOR ANY HARDWARE FAILURE, INCLUDING BUT NOT LIMITED TO, FAILURES OF COMPUTERS, SERVERS, NETWORKS, CONNECTIONS AND OTHER ELECTRONIC OR MECHANICAL EQUIPMENT OR SOFTWARE FAILURE, INCLUDING BUT NOT LIMITED TO BUGS, ERRORS, VIRUSES, CONFIGURATION PROBLEMS, INCOMPATABILITY OF SYSTEMS, THE OPERATION OF FIREWALLS, SCREENING PROGRAMS OR UNREADABLE CODES.  

    NOW HEALTH GROUP, INC. SHALL NOT BE LIABILE OR RESPONSIBLE FOR ANY CLAIMS, ACTIONS OR DAMAGE OF ANY KIND RESULTING FROM THE NOW® PROMOTIONAL CODES OR NOW® PROMOTIONAL CODE PROGRAM.  TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE STATE AND LOCAL LAW, NOW HEALTH GROUP, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE NOW® PROMOTIONAL CODES, AND NOW HEALTH GROUP, INC. WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM ANYONE’S PARTICIPATION IN THE NOW® PROMOTIONAL CODE PROGRAM, INCLUDING BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. WITHOUT LIMITING THE FOREGOING, THIS DISCLAIMER DOES NOT APPLY TO ANY PRODUCT WARRANTY OFFERED BY NOW HEALTH GROUP, INC. FOR ANY PRODUCT PURCHASED ON THE NOW-2-U.COM SITE. 

    CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS OF IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES.  IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU.

Territorial Use Restrictions, Governing Law and Jurisdiction.  This Program is operated by NOW in the United States.  NOW makes no representation that this Program complies with any applicable laws outside the United States.  This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois.  All claims, disputes, and lawsuits arising out of or in connection with this Agreement shall be resolved or adjudicated in DuPage County, Illinois.
  6. General Terms.  If any provision of this Agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severed from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
